I N T R O D U C T I O N:

In exercise of the power conferred by the Section 26 & 27 of Trademarks Rules 2015 under S.R.O No. 272-Law/2015, Government of Bangladesh,  Centre for Policy Research, Bangladesh is publishing the second version of the Regulations 2018 to be called the Regulations for the use of Collective Mark of Cantre for Policy Research, Bangladesh: 2018.

B A C K G R O U N D:

Centre for Policy Research, Bangladesh (Hereinafter called the CPR, Bangladesh), is a specialized Research and Innovation (R&I) centre, duly registered under the laws of Bangladesh, having Registration No. L-732016015643-H that was established in February 24, 2008 for national Policy, Process and Strategy development, based on The New (Matrix) Method of Economic Analysis.

A. Short title and commencement: This regulations may be called the Regulations for the use of Collective Mark of Centre for Policy Research, Bangladesh: 2018  (Second Version).

B. D E F I N I T I O N S :

  1. License Parties and Strategic Partners mean License Parties and Strategic Partners of the CPR, Bangladesh;
  2. Franchise Parties and Strategic Partners mean Franchise Parties and Strategic Partners of the CPR, Bangladesh;
  3. License Parties and Strategic Partners mean License Parties and Strategic Partners of the CPR, Bangladesh;
  4. The Collective Mark of the CPR, Bangladesh means the Logo and Mark of CPR, Bangladesh, integration with the trade secrets, models, (Business Model, Economic Model), operational mechanisms and intellectual assets of the CPR, Bangladesh;
  5. The Logo means the mark of Centre for Policy Research, Bangladesh or CPR, Bangladesh;
  6. The Mark means Centre for Policy Research, Bangladesh or the CPR, Bangladesh;
  7. The Trade Secrets mean the trade secret documents of the CPR, Bangladesh;
  8. The New (Matrix) Method of Economic Analysis means an international level intellectual asset of the CPR, Bangladesh;
  9. The IIC – Innovation & Innovator Cell means the intellectual asset of the CPR, Bangladesh;
  10. The IPDP – Intellectual Property Development Program means a high impact international intellectual asset of the CPR, Bangladesh;
  11. Business Models mean the business models of the CPR, Bangladesh that will work at the creation and development of world class innovation, new product or process and its commercialization and industrialization at national and international level;
  12. Economic Models mean the Economic models of the CPR, Bangladesh that will work at the creation and development of world class innovation, new product or process and its commercialization and industrialization at national and international level;
  13. Operational Mechanisms mean the operational mechanisms of the CPR, Bangladesh that will work at the creation or development of world class product or process and its commercialization and industrialization at national and global level;
  14. The Register means containing a record of the “Collective Mark” of the CPR, Bangladesh;
  15. Basic Commitments mean the Agreement between Centre for Policy Research, Bangladesh and Franchise Party or License Party and Strategic Partner;
  16. The Principles Rules of the Operations mean an “Integrated Innovation Management Framework” governed by Centre for Policy Research, Bangladesh and Franchise Parties or License Parties and Strategic Partners of CPR, Bangladesh;
  17. Head of the CPR Bangladesh means Managing Partner of Centre for Policy Research, Bangladesh;
  18. Management of the CPR, Bangladesh means Managing Partner, Senior Partner, CEO, Partners, Network Partners, Strategic Partners and other management Performers of the Collective Mark of the CPR, Bangladesh.

C.  P U R P O S E : Centre for Policy Research, Bangladesh is intended to secure the intellectual assets under the Collective Mark of the CPR, Bangladesh under the Trademark Law of Bangladesh for commercial and industrial exploitation of the Collective Mark of the CPR, Bangladesh at national and international level.

D. Implementation: The implementation under the basis commitment for the use of Collective Mark of the CPR, Bangladesh to the Franchise or License Party and Strategic Partner of the CPR, Bangladesh at national and international level.

E.  Shape of the Logo: The Logo of the CPR, Bangladesh is protected in all sizes and has the following shape and design:

The master version of the logo may not be reconstructed or altered in any way. The master version of the logo shall be used for Centre for Policy Research, Bangladesh and Franchise Party or License Party and Strategic Partner of the CPR, Bangladesh.

F.  Change the Regulations:

  1. These regulations may be amended, suspended or cancelled only with the Centre for Policy Research, Bangladesh or by the order of Supreme Court of Bangladesh.
  2. License Parties or Franchise Parties and Strategic Partners shall be given notice of any such variation, amendment, suspension of the regulations for the use of “Collective Mark” of the CPR, Bangladesh to Centre for Policy Research, Bangladesh. Notice shall be given in writing and sent by Email or post within 10 working days, after the posting.

G. Repeal and Saving of the Existing Regulations :

  1. The regulations for the use of Collective Mark of Centre for Policy Research, Bangladesh, 2016 (Hereinafter referred to the repealed regulations for the use of Collective Mark of the CPR, Bangladesh) shall be repealed immediately as the new regulation come into Force.
  2. In this event that all kinds of agreements, IP assets and other development works of the CPR, Bangladesh at national and international level have been executed by the repealed regulations that will be taken under the regulations for the use of Collective Mark of the CPR, Bangladesh : 2018.

H.  G E N E R A L :

The conditions for the use of “Collective Mark” of the CPR, Bangladesh shall be primarily governed by and constitute in accordance with Trademark Law of Bangladesh. The aggrieved parties may submit any dispute arising here-under any competent court of Bangladesh.
