The Regulations for the use of Collective Mark of Cantre for Policy Research, Bangladesh: Second Version 2018

B A C K G R O U N D:

Centre for Policy Research, Bangladesh (Hereinafter called “CPR, Bangladesh”), is a Partnership Firm duly registered under the laws of Bangladesh, having Registration No. L-732016015643-H with the office address at House 4, Apartment A-2, Road 124, Gulshan-1, Dhaka-1212, Bangladesh

The main activities of the Firm: CPR, Bangladesh is a “Research Centre” which was established in February 24, 2008 for National Policy, Process and Strategy development based on the “New (Matrix) Method of Economic Analysis”. The Firm has developed for commercial and industrial exploitation of the “Collective Mark” of “CPR, Bangladesh”.

The “Collective Mark” is used only by “License or Franchise Parties” and “Strategic Partners” of “Centre for Policy Research, Bangladesh” at nation and international level.

“CPR, Bangladesh” activities to disseminate national ‘Innovations’ through the kinds of actions:

● Support to Applied Research ● Support to Innovation ● Support to Technology Transfer ● Support to Innovation Management ● Support to Technology Licensing

The Firm has developed the below intellectual assets which are integrated the trade secrets, business model, economic model and operational mechanisms of CPR, Bangladesh to solve the most perpetual intellectual property (IP) business problems of the developing countries in the world.

1. The Innovation & Innovator Cell (IIC) development under Public-Private Partnership
Background: Centre for Policy Research, Bangladesh has been developing the Framework of “The Innovation & Innovator Cell (IIC) development under Public-Private Partnership” since 2008. CPR, Bangladesh and Khulna University of Engineering & Technology (KUET) have established the IIC – Innovation & Innovation Cell at KUET through a “Joint Venture & License Agreement” on March 31, 2016 based on the following claims of the IIC – Innovation & Innovator Cell:Claim-I: There is no institutional backbone for intellectual property technology transfer and innovation management in Bangladesh.

Claim-II: It is difficult to manage the innovations for government alone without an “Innovative Industrial Environment” in Bangladesh

2 The Intellectual Property Development Program (IPDP)
Background: Centre for Policy Research, Bangladesh has been developing the Framework of the “Intellectual Property Development Program (IPDP) since 2012 based on the following claims of the IPDP – Intellectual Property Development Program:Claim-I: The contemporary existing institutional mechanisms, models, policy, programs and laws in the world are not working properly to solve the most perpetual intellectual property (IP) problems of developing counties in the world for creation and development of intellectual property and its commercialization and industrialization.

The Firm also started out the following concepts in transferring skills into various stakeholders of Bangladesh:

  • Support to develop ‘Innovation and Technology Transfer Policy and Strategy: Bangladesh’ .
  • Support to develop National Industrial Policy, Education Policy, Financial Policy, Science, Technology and Innovation (STI) Policy, Intellectual Property (IP) Policy and other national development Policy of Bangladesh.

1. Short Title and Commencement: This regulations may be called “The Regulations for the use of Collective Mark of Centre for Policy Research, Bangladesh: 2018”

2. D E F I N I T I O N S :

  • “License Parties and Strategic Partners” mean License Parties and Strategic Partners of CPR, Bangladesh;
  • “Franchise Parties and Strategic Partners” mean Franchise Parties and Strategic Partners of CPR, Bangladesh;
  • “License Parties and Strategic Partners” mean License Parties and Strategic Partners of CPR, Bangladesh;
  • “The Collective Mark of CPR, Bangladesh” means the Logo and Mark of CPR, Bangladesh, integration with the trade secrets, models, (Business Model, Economic Model), operational mechanisms and intellectual assets of CPR, Bangladesh;
  • “The Logo” means the mark of Centre for Policy Research, Bangladesh or CPR, Bangladesh;
  • The Mark means Centre for Policy Research, Bangladesh or CPR, Bangladesh;
  • “Trade Secrets” mean the trade secret documents of CPR, Bangladesh;
  • “The New (Matrix) Method of Economic Analysis” means an international level intellectual asset of CPR, Bangladesh;
  • “The IIC – Innovation & Innovator Cell” means the intellectual asset of CPR, Bangladesh;
  • “The IPDP – Intellectual Property Development Program” means ahigh impact international intellectual asset of CPR, Bangladesh;
  • “Business Models” mean the business models of CPR, Bangladesh that will work at the creation and development of world class innovation, new product or process and its commercialization and industrialization at national and international level;
  • “Economic Models” mean the Economic models of CPR, Bangladesh that will work at the creation and development of world class innovation, new product or process and its commercialization and industrialization at national and international level;
  • “Operational Mechanisms” mean the operational mechanisms of CPR, Bangladesh that will work at the creation and development of world class innovation, new product or process and its commercialization and industrialization at national and global level;
  • “Register” means containing a record of the “Collective Mark” of CPR, Bangladesh;
  • “Basic Commitments” mean the Agreement between Centre for Policy Research, Bangladesh and Franchise Party or License Party and Strategic Partner’;
  • “The Principles Rules of the Operations” mean an “Integrated Innovation Management Framework” governed by Centre for Policy Research, Bangladesh and Franchise Parties or License Parties and Strategic Partners of Centre for Policy Research, Bangladesh;
  • “Head of CPR Bangladesh” means Managing Partner of Centre for Policy Research, Bangladesh;
  • “Management Team of CPR, Bangladesh” means Managing Partner, Senior Partner, CEO, Partners, Network Partners, and other management Performers of the Collective Mark of CPR, Bangladesh.

3. P U R P O S E : Centre for Policy Research, Bangladesh is intended to secure the intellectual assets under the Collective Mark of CPR, Bangladesh under the Trademark Law of Bangladesh for commercial and industrial exploitation of the “Collective Mark” of CPR, Bangladesh at national and international level.

The implementation under the basis commitment for the use of “Collective Mark” of CPR, Bangladesh to Franchise or License Party and Strategic Partner at national and international level.

4. Shape of the Logo: The Logo of CPR, Bangladesh is protected in all sizes and has the following shape and design:

The master version of the logo may not be reconstructed or altered in any way. The master version of the logo shall be used for Centre for Policy Research, Bangladesh and Franchise Party or License Party and Strategic Partner of Centre for Policy Research, Bangladesh.

4. Change the Regulations:

  • These regulations may be amended, suspended or cancelled only with the Centre for Policy Research, Bangladesh or by the order of Supreme Court of Bangladesh.
  • License Parties or Franchise Parties and Strategic Partners shall be given notice of any such variation, amendment, suspension of the regulations for the use of “Collective Mark” of CPR, Bangladesh to Centre for Policy Research, Bangladesh. Notice shall be given in writing and sent by Email or post within 10 working days, after the posting.

5. Repeal and Saving of the Existing Regulations : The regulations for the use of Collective Mark of Centre for Policy Research, Bangladesh, 2016 (Hereinafter referred to the repealed regulations for the use of Collective Mark of Centre for Policy Research, Bangladesh) shall be repealed immediately as the new regulation come into Force.

  • In this event that all kinds of agreements, IP assets and other development works of CPR, Bangladesh at national and international level have been executed by the repealed regulations that will be taken under the regulations for the use of Collective Mark of Centre for Policy Research, Bangladesh : 2018.

6. G E N E R A L :

The conditions for the use of “Collective Mark” of CPR, Bangladesh shall be primarily governed by and constitute in accordance with Trademark Law of Bangladesh. The aggrieved parties may submit any dispute arising here-under any competent court of Bangladesh.
